Terms of Service

These terms govern your use of the Mission Made Homes website, including Marlo, our AI assistant, and customer accounts. The actual home-purchase contract is a separate document you sign during the order phase of your build, and installation and site work are provided under a separate installation contract with TCM Capital Inc. (CSLB #1122754), our affiliated licensed contractor.

Notice regarding dispute resolution

These Terms contain an agreement to resolve disputes about the website through binding individual arbitration, along with a waiver of jury trials and class actions, unless you opt out within 30 days. See “Dispute resolution and arbitration” below, including the opt-out procedure. This applies to website and account disputes; your purchase and installation contracts contain their own dispute terms.

Using this website

This website is provided for general information about manufactured homes, floor plans, pricing, and our services. By using it, you agree to these terms. Please use the site lawfully and do not attempt to disrupt it or misuse its content.

You must be at least 18 to create an account, submit a quote or build request, pay a deposit, or enter into a transaction with us. General website information is not directed to children.

Marlo, our AI assistant

Marlo is an AI assistant, not a person. Its responses are generated automatically and may be incomplete, inaccurate, or out of date. They are general information only and are not a quote, offer, promise, purchase agreement, or legal, financial, tax, or other professional advice. Please verify pricing, availability, financing, deposits, warranties, and other material information with an authorized Mission Made Homes team member before relying on it or taking action.

A Marlo response does not by itself create or change a purchase agreement, written quote, warranty, deposit or refund policy, price-match terms, or rights provided by law. Written documents issued or approved by an authorized representative, and signed where required, govern those matters.

We store Marlo chats and related interaction information, and our team may review them to respond, improve the service, or follow up when you ask us to. Some chat content may be processed by our AI service provider as explained in our Privacy Policy. Do not enter Social Security numbers, government identification numbers, banking or payment-card information, passwords, medical information, or other sensitive personal information into Marlo.

By sending a message to Marlo, you agree to these Terms and acknowledge our Privacy Policy, including the storage and review of chats described above.

Pricing and estimates are not purchase agreements

Website prices and estimated monthly payments are provided for general guidance. Using the site or submitting a configuration does not complete a home purchase or create a financing agreement. Before preparing proposed purchase documents, we review selections, manufacturer availability, site assumptions, and pricing calculations. Final price, included work, and specifications are stated in the applicable signed purchase documents, including incorporated schedules and signed changes. Financing terms are set by your lender. Nothing in these Terms limits rights or obligations under applicable law.

Renderings and images are illustrative

Renderings, illustrations, photographs, floor plans, virtual tours, and configurator views shown on the site, including images provided by manufacturers and images created or assisted by digital or AI tools, are for illustration only. They may show optional features, upgrades, furnishings, or site conditions that are not included in a base price, and actual homes, finishes, and dimensions may differ. The specifications in your signed purchase documents, not site imagery, define what is included in your home.

Your site, permits, and local requirements

Whether a particular home can be placed on a particular property, and how it may be used, depends on local zoning, permitting, utility, foundation, and other site-specific requirements, and on the rules of any community or park where the home will be located. General information on this site, including from Marlo, is not a determination that a home is permitted or suitable for your property. Site evaluations, permit applications, and installation scopes are addressed in the purchase and installation documents for your project, and you are responsible for information you provide about your property and its intended use.

Accounts and saved builds

When you submit a configured build or quote request, we may create a free customer account using the email address you provide so we can preserve the build and send you a secure sign-in link. Please provide accurate information, keep your email account and sign-in links secure, and tell us promptly about suspected unauthorized access. Accounts and sign-in links may not be transferred or misused.

Saved builds are historical snapshots for convenience. They may show the selections and estimate available when saved, but they are not current quotes or purchase agreements. We may suspend access when reasonably necessary for security, unlawful use, or legal compliance. Suspension or account closure does not cancel a transaction or limit records and rights that must be preserved by law or contract.

Information you send us

You retain ownership of messages, documents, and other content you submit. You give us permission to use that content only as reasonably needed to respond, operate and improve the service, maintain your account or lead record, and comply with law, as described in the Privacy Policy. Do not submit content that is unlawful, infringing, malicious, impersonates another person, or interferes with the security or operation of the site.

Intellectual property

The content on this site, including text, images, and design, is owned by Mission Made Homes or its licensors and is protected by law. You may not reproduce or reuse it without permission, except as permitted by law and as allowed for personal, noncommercial reference.

Disclaimers

The site is provided on an "as is" and "as available" basis without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the site will be error-free or uninterrupted, or that all information is complete or current.

Limits relating to website use

To the extent permitted by law, Mission Homes Retail LLC (dba Mission Made Homes) is not responsible for indirect, incidental, special, or consequential losses arising solely from use of, or inability to use, this website or Marlo. This limitation does not apply to our fraud, willful misconduct, gross negligence, personal injury or property damage caused by us, violation of law, privacy or data-security obligations, or rights and remedies that cannot legally be limited. It also does not limit obligations under a purchase agreement, installation agreement, warranty, deposit or escrow document, or other transaction document.

How these Terms fit with other documents

These Terms, the Privacy Policy, and notices presented for particular website features govern website and account use only. They do not replace or modify a written quote, purchase agreement, installation agreement, incorporated schedule, signed change order, deposit receipt, escrow instruction, warranty, financing document, or published price-match terms. Agreeing to these Terms is not consent to receive marketing calls or text messages; that consent is requested separately where applicable.

If a provision of these Terms cannot be enforced, the remaining provisions remain effective to the extent permitted by law. Our failure to enforce a provision once is not a waiver of it. Provisions that by their nature should continue after account closure, including ownership, permitted-use, liability, and dispute provisions, will continue.

We may assign these Terms in connection with a merger, reorganization, financing, or sale of the business if the successor assumes our obligations. You may not transfer your account to another person.

Changes to these Terms

We may update these Terms prospectively. We will update the date above and provide reasonable notice of material changes, such as by email or an account notice. When a change materially affects your rights, we may ask you to accept the revised Terms before continuing to use the affected feature. The version accepted when a dispute or transaction arose generally governs that matter unless the parties validly agree otherwise or applicable law requires a different result.

Dispute resolution and arbitration

Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court and to have a jury trial. It applies to disputes about these Terms and your use of the website, Marlo, and customer accounts. It does not replace or modify the dispute-resolution terms in a signed purchase agreement, installation agreement, or other transaction document, which govern disputes arising under those documents.

Talk to us first

Most concerns can be resolved quickly and informally. Before starting an arbitration or lawsuit, you and we each agree to first send the other a written description of the dispute and what resolution is requested (for you, by email to legal@missionmadehomes.com or by mail to the address below) and to try in good faith to resolve it for at least 30 days. This informal step is a precondition to starting any arbitration or lawsuit.

Agreement to binding individual arbitration

If we cannot resolve a dispute informally, you and Mission Homes Retail LLC (dba Mission Made Homes) agree that any dispute, claim, or controversy arising out of or relating to these Terms or your access to or use of the website, Marlo, or a customer account will be resolved by final and binding arbitration before a single neutral arbitrator, rather than in court, except as stated in the exceptions below. The arbitration will be administered by JAMS under its Streamlined Arbitration Rules and Procedures and, where applicable, its Consumer Arbitration Minimum Standards, available at jamsadr.com. The Federal Arbitration Act governs the interpretation and enforcement of this section. The arbitrator, and not any court or agency, has exclusive authority to resolve disputes about the interpretation, applicability, enforceability, or formation of this arbitration agreement.

The arbitration will take place in Fresno County, California, or, at your election, by telephone or video conference. If your filing fee exceeds the amount you would pay to file a lawsuit in court, we will pay the difference, and we will pay the arbitration fees and costs required of us under the JAMS consumer standards. Each side bears its own attorney fees and costs unless the arbitrator awards them under applicable law. The arbitrator may award the same individual relief that a court could award, must issue a written decision explaining the essential findings and conclusions, and the award may be entered as a judgment in any court of competent jurisdiction.

No class actions; jury trial waiver

You and we each agree that disputes will be brought only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding, and each of us waives the right to a trial by jury. The arbitrator may not consolidate claims or preside over any form of class or representative proceeding. If a court or arbitrator determines that this class-action waiver is unenforceable as to a particular dispute, then the agreement to arbitrate does not apply to that dispute, which shall proceed in court, and this section otherwise remains in effect.

Exceptions

Either party may bring a qualifying claim in small claims court instead of arbitration. This section also does not prevent claims that by law cannot be subject to a pre-dispute arbitration agreement, including qualifying claims under the California Private Attorneys General Act, and either party may seek temporary injunctive relief in court to protect intellectual property or the security of the Service pending arbitration.

Coordinated (mass) filings

If 25 or more demands for arbitration are filed against us raising similar claims and represented by the same or coordinated counsel, you and we agree those demands will instead be administered by National Arbitration and Mediation (NAM) under its Mass Filing Supplemental Dispute Resolution Rules and Procedures then in effect, excluding any rules permitting class arbitration. A court of competent jurisdiction may compel compliance with this paragraph, and related arbitrations and fee obligations are stayed while any such request is pending.

Your right to opt out

You may opt out of this arbitration agreement and class-action waiver, and it will not apply to you, by mailing a written, signed notice stating your name, contact information, and your decision to opt out to: Mission Homes Retail LLC (dba Mission Made Homes), Attn: Legal (Arbitration Opt-Out), 6777 N Willow Ave Ste 137, Fresno, CA 93710, postmarked within 30 days of the date you first accept these Terms. Opting out does not affect any other part of these Terms.

Changes to this section; survival

If we make a material change to this dispute-resolution section, you may reject the change by continuing to use the website under the prior version of this section for disputes that arose before the change. This section survives account closure and the end of your use of the website.

Governing law and venue

These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. For any dispute not subject to arbitration (including if you opt out) other than small-claims matters, you and we consent to the exclusive jurisdiction of the state and federal courts located in Fresno County, California, except that you may bring a small-claims action in the county where you reside.
